1. Acceptance of Terms

By accessing events.360ism.com (“Site”) or purchasing any ticket, rental, or service (“Event”), you (“Customer,” “you”) agree to be bound by these Terms & Conditions (“Terms”) and all applicable laws. If you do not agree, do not use this Site. 360ism Studios (“360ism,” “we,” “our”) reserves the right to modify these Terms at any time; the updated version will be posted with a new “Last updated” date and is effective immediately.

2. Eligibility

• Age Requirement: You must be at least 18 years of age.

• Authority: You represent that you have the right, authority, and capacity to enter into these Terms on behalf of yourself or the entity you represent.

3. Booking & Payment

1. Pricing: All prices are listed in U.S. dollars and are subject to change without notice.

2. Taxes & Fees: Applicable taxes or third-party fees (payment gateway, service fees) are added at checkout.

3. Accepted Methods: We accept major credit cards, PayPal, Afterpay, and Affirm via WooCommerce.

4. Reservation Confirmation: Your booking is confirmed only after full payment is processed and a confirmation email is sent.

5. Overtime: Studio use beyond the reserved time is billed in 15-minute increments at the prevailing hourly rate.

4. Cancellation, Rescheduling & Refunds

Group shoots are limited-capacity; forfeited slots are rarely refillable on short notice.

5. Conduct & Usage Rules

• Professional Environment: No harassment, hateful speech, or unlawful behavior toward staff, models, or other customers.

• Prohibited Content: Absolutely no pornographic recording, explicit sexual acts, firearms, controlled substances, or open flames.

• Crew & Assistants: One assistant per paid ticket; each must sign our standard NDA and follow all house rules.

• Cleanup: You must leave the space in “broom-clean” condition. Excessive mess incurs a $50 cleaning charge.

6. Model Release & Intellectual Property

1. Personal-Use License: Standard tickets include a non-exclusive, worldwide, perpetual license for portfolio, social media, and self-promotion.

2. Commercial License: Selling prints, NFTs, or commercial campaigns requires a separate written agreement and fee.

3. Attribution: Tag @360ism.studios and the model’s handle whenever images are posted online.

4. Studio Content: Video or photo featuring 360ism property or branding may be reposted by 360ism for promotional purposes, crediting the photographer.

7. Equipment & Damage

You are responsible for any damage, theft, or excessive wear to studio equipment and props during your booking. Replacement or repair costs (plus downtime) will be invoiced within 5 business days.

8. Assumption of Risk & Liability Waiver

Photography involves physical movement, lighting equipment, and electrical cables. By participating, you assume all inherent risks and agree to release and hold harmless 360ism Studios LLC, its officers, agents, employees, and models from any liability for injury, loss, or damage arising from the Event, except to the extent caused by 360ism’s gross negligence or willful misconduct.

9. Indemnification

You agree to indemnify and defend 360ism from any claims, damages, or expenses (including attorney’s fees) arising out of your breach of these Terms or misuse of the Site.

10. Dispute Resolution & Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia without regard to conflict-of-law principles. Any dispute shall be resolved exclusively in the state or federal courts located in Richmond, VA. You consent to personal jurisdiction in those courts.

11. Severability & Entire Agreement

If any provision is deemed unenforceable, the remaining provisions will remain in full force. These Terms constitute the entire agreement between you and 360ism regarding the Site and Events, superseding prior oral or written agreements.
